When the parties of a family law matter cannot resolve the issues of their case through settlement or mediation, the only other recourse is to proceed with a trial on the unresolved issues. A Motion to Set and Certificate of Readiness is a legal document that is submitted to the Court to indicate that a party is ready to proceed with a trial. This motion should only be filed when:
- A petition has been filed and the opposing party has appeared and/or responded;
- Discovery (process of fact finding and evidence gathering) has been completed;
- There are unresolved issues remaining in the legal matter; and
- The filing party is ready to proceed with trial.
